Maryland Lead Inspections

 

Who Is Required To Have Lead Inspections

·      The Maryland Department of the Environment (MDE) has mandated all residential rental dwelling units built prior to 1978 are required to be lead inspected by a MDE accredited lead paint inspector if there is not a report that the property is lead free.

When Are Lead Inspections Performed

·      Any time there is a change in tenancy in afore mentioned MD dwelling unit.

·      When requested in DC and VA

·       Child with elevated blood lead level (Risk Assessment)

In 1978, the federal government banned consumer uses of lead-containing paint, but some states banned it even earlier. MDE requires a 24 hour notification before an inspection can be scheduled.

Dust Sampling Inspection Process

This inspection presumes that all paint is lead-based paint.  Like asbestos, as long as the paint is in good condition, it is not considered hazardous.  The first part of the inspection is a Visual review.  If paint is not in good condition, dust samples cannot be collected.

1. Visual Review.

·      Go around outside of house / unit and check there is no chipping, peeling, flaking paint, cracking or deteriorating painted surfaces.

·      Go through inside of house / unit and make sure there is no chipping, peeling, flaking, cracking, or deteriorating paint.

·      Go through inside of house / unit and make sure there is no visible dust and debris or paint chips.

·      Go through inside of house / unit and check that there are no painted doors that rub, causes paint dust or deterioration.

2. If visual review passes, collect dust samples from window sills or floors and window well (if the windows are wood) and submit to the lab.

·      Usually one sample per room (Maryland) unless there are one or more wood windows. Two samples collected in rooms with wood window, one from window well and another from floor or window sill.

·      Two dust samples per room with window in Virginia, DC, and Daycare Centers.

1. Refresh Paint. Make sure there is no chipping, peeling, flaking, cracking, or deterioration of painted surfaces anywhere, indoors and outdoors.

2. Clean Inside. Make sure all surfaces, particularly floors, window sills, and window wells are clean and dust free. Most dust sample failures occur in areas where cleaning is often neglected (i.e. basement/garage floors and window wells).  Thoroughly cleaned properties are more likely to pass dust wipe testing the first visit.

3. Remove Debris. Make sure there are no chips of paint on ground or floors due to scraping of paint.

4. Trim Doors. Make sure painted doors do not rub when opening and closing.

5. Repair Exterior. Be sure to check condition of paint on any shed, deck, patio, garage, railings, columns, and other exterior painted surfaces too.

·      A sample is a swipe taken from a small area in a room for the lab to evaluate for lead content.

·      Usually there is one sample taken per room unless there is a wood window, then two samples are collected from that room.

·      A room may be a kitchen, bedroom, foyer, hallway, dining room, bathroom, powder room, living room, laundry room, rec. room, office, etc.
